Challenge a decision the right way

If your visa has been refused or cancelled, you may have a right to merits review at the Administrative Review Tribunal (ART), which replaced the Administrative Appeals Tribunal (AAT) on 14 October 2024. Strict time limits apply — usually 21 or 28 days from notification depending on the decision and where you are. Acting quickly is critical.

ART – Merits Review

Who it's for: Visa applicants and sponsors whose application has been refused or cancelled and who have review rights.

The Administrative Review Tribunal (Migration & Refugee jurisdiction) reconducts the decision on the merits. We assist with preparing the application for review, gathering evidence, drafting submissions and representing you at hearings.

Notice of Intention to Consider Cancellation (NOICC)

Who it's for: Visa holders whose visa is being considered for cancellation by the Department of Home Affairs.

A NOICC requires a carefully prepared written response within the time frame stated in the notice. Failure to respond properly can result in visa cancellation. We help you prepare a comprehensive response.

Important things to know

  • Time limits are strict and generally cannot be extended. Contact us immediately if you receive a refusal, cancellation notice or NOICC.
  • Some decisions (e.g. character cancellations under s501) may have different review pathways including the Federal Court.
